How UAE gratuity is calculated

  • Gratuity is paid on your last basic salary only; allowances are excluded.
  • You earn 21 days of basic pay for each of the first 5 years, then 30 days for each further year.
  • You must complete at least 1 year of continuous service to qualify.
  • Partial years count: time beyond a full year is paid pro-rata.
  • Resignation does not reduce your gratuity. The old reductions for resigning (one-third and two-thirds) were abolished in 2022, and the limited vs unlimited contract distinction is gone.
  • Total gratuity cannot exceed two years' wage.
  • Your employer must pay your final dues within 14 days of your last working day.
  • This applies to mainland (MOHRE) and ADGM. DIFC is different. It uses the funded DEWS savings scheme, not this formula.

Is gratuity calculated on basic or total salary?

On your basic salary only. Housing, transport, and other allowances are excluded. Only the two-year maximum cap uses your total salary.

Do I get gratuity if I resign?

Yes. Since the 2022 labour law, resignation does not reduce your gratuity. If you have at least one year of service you receive the full amount, the same as someone who is terminated. The old one-third and two-thirds deductions for resigning were abolished.

What is the minimum service to qualify for gratuity?

One full year of continuous service. Below one year, no gratuity is due, though you are still owed any unpaid salary and unused leave.

How many days of pay do I get per year?

21 days of basic salary for each of your first five years, and 30 days for each year after that.

How is gratuity calculated after 5 years?

Your first five years accrue at 21 days per year, which is 105 days. Every year beyond five accrues at the higher rate of 30 days per year, added on top.

Is gratuity paid if I am terminated or dismissed?

Yes. Gratuity is owed whether you resign, are terminated, or your contract ends, once you have one year of service. Even dismissal for misconduct under Article 44 no longer automatically forfeits it; a court can order a deduction only in proven-loss cases.

Does this work for Dubai, Abu Dhabi, and free zones?

Yes for mainland companies across all emirates and for ADGM, which use the same formula. DIFC is the exception: DIFC employees are on the funded DEWS savings scheme, not this gratuity calculation.

How long does my employer have to pay my gratuity?

Within 14 days of your last working day, your employer must settle your end-of-service gratuity and any other final dues.
